Who is responsible for your information?

Hercules Philippus Erasmus, a full-status property practitioner at Prime Auctions Group Tzaneen (Smartprop Solutions (Pty) Ltd), Tzaneen, Limpopo, is the responsible party for the personal information described in this policy. We handle it in accordance with the Protection of Personal Information Act (POPIA).

Contact: hercules@primeauctions.co.za or 078 156 1499.

What we collect

  • Details you send through the website contact form: name, email, phone number and message.
  • Property valuation request details, including those submitted through Meta (Facebook/Instagram) lead forms: name, phone number, email, property type, area, size and selling timeframe.
  • WhatsApp, phone and email correspondence.
  • When enabled and permitted, website usage data collected by cookies and the Meta Pixel: pages and listings viewed, device and browser information, and IP address.

Why we use your information

We use your information to respond to enquiries, arrange viewings, prepare property valuations, market properties for which we hold mandates, measure and improve our Facebook and Instagram advertising, and meet legal obligations under the Property Practitioners Act and the Financial Intelligence Centre Act (FICA).

Under section 69 of POPIA, we send electronic direct marketing only with your consent or to existing clients for similar services where the law allows it. Every marketing message includes an opt-out. You can also object to direct marketing at any time by contacting us.

Who we share it with

We do not sell your personal information. We share it only with Prime Auctions Group / Smartprop Solutions, service providers needed to deliver our services (including website hosting and Meta Platforms as our advertising and lead form provider), conveyancers, attorneys and financiers involved in a transaction with your consent, or when the law requires it.

Meta may process information outside South Africa under its own safeguards and privacy policies.

How long we keep it

Enquiry and valuation records are kept only as long as needed for their purpose, generally up to 12 months after our last contact unless a transaction follows. Transaction and FICA records are kept for at least 5 years as required by law. When records are no longer needed and legal retention requirements have been met, we securely delete them.

Keeping your information secure

We use reasonable technical and organisational measures to protect personal information against loss, unauthorised access, disclosure, alteration and destruction.

Your rights under POPIA

You may request access to your personal information, ask for correction or deletion where applicable, object to processing and direct marketing, withdraw consent, or complain to the Information Regulator. Withdrawing consent does not affect processing lawfully carried out before withdrawal. Some records must be retained to meet legal obligations.

To exercise these rights, including withdrawing consent for valuation follow-up or marketing, email or call us using the contact details above. We may need to confirm your identity before releasing or changing records.

Cookies and the Meta Pixel

This site may use the Meta Pixel to measure visits from our Facebook and Instagram ads and to show relevant ads to people who have visited. When enabled, it shares website usage information with Meta Platforms for advertising measurement and optimisation. The Meta Pixel is active on this website.

If enabled, tracking remains blocked in regions requiring prior consent, and when your region cannot be determined, unless an appropriate advertising consent process is introduced. Ad clicks and impressions can still be counted by Facebook and Instagram without this website tracking.

You can control cookies and tracking through your browser settings and ad blockers, and manage your advertising choices through Facebook’s “Ad preferences” and “Off-Facebook activity” settings. This site honours supported browser Do Not Track and Global Privacy Control signals. To withdraw consent or object to our use of your information, contact us above; you may also block future browser tracking through these settings.

Changes to this policy

We may update this policy when our services, practices or legal requirements change. The latest version will be available on this page with a revised “Last updated” date.
